Terms of sale

1. GENERAL PROVISIONS

1.1. These Black Pepper Online Store Terms and Conditions (hereinafter: e-Shop) Terms and Conditions (hereinafter: Terms and Conditions) apply to the purchase of Black Pepper online at www.blackpepper.ee. The seller of the goods is Kvarts Trading OÜ (hereinafter the seller), address Puuvilja3 Tallinn 11618, registry code 14006503, phone 5246207, e-mail address info@blackpepper.ee. The Terms and Conditions apply to all legal persons (hereinafter referred to as the Customer) and the Seller through the Black Pepper Online Store for legal relations arising from the purchase of the Goods.

1.2. The Seller has the right to unilaterally amend and supplement the Terms by publishing new terms and conditions at https://www.blackpepper.ee/muugiting conditions/. If the customer placed an order before the terms change came into force, the terms and conditions of the customer and the seller at the time the order was placed will apply.

1.3. The customer can save, print and, if necessary, reproduce the conditions before making the purchase, and the customer agrees with the terms and conditions of the purchase in the online store.

1.4. In addition to the terms and conditions, the legislation in force in the Republic of Estonia applies to the purchase of the e-shop.


2. SUBMISSION OF ORDER

2.1. Orders can be placed in the e-shop either by logging in as a customer or as an anonymous client.

2.2. The customer selects the desired goods from the e-shop and adds them to the shopping cart.

2.3. Each item is booked separately in the shopping cart for 40 minutes.

2.5. The customer chooses the method and place of delivery of the order.

2.6. The customer confirms the cart and pays for the goods in the payment environment offered by the seller. Before paying the invoice, the customer checks that the information on the invoice corresponds to the actual request of the client.

2.7. After paying for the goods, the customer must click on the link "Back to the merchant".

2.8. The seller will send a confirmation and invoice to the customer about the receipt of the order and payment.

2.9. The sales contract between the seller and the customer becomes effective from the receipt of the purchase amount paid by the customer to the Seller's current account.

2.11. Goods that cannot be completed will be refunded by the Seller to the Customer within 14 days at the latest.

3. COMMODITY PRICE, PAYMENT OPTIONS

3.1. All prices of goods sold in the e-shop are shown in euros and include 20% VAT.

3.2. Customers who have logged in are eligible for the Customer's benefits in the e-shop.

3.3. The customer pays the purchase price of the goods and the delivery fee in full for the order. Payment is made outside the e-store in a secure environment - when paying with a bank link in a secure environment of the respective bank. The seller has no access to the customer's bank and credit card information.

3.4. The commodity delivery fee is added to the sales price in accordance with clauses 4.3 and 4.4 of the Terms of Sale

3.5. You can pay for the goods in the ways shown in the online shop. The cost of the order may be supplemented by a service charge according to the contract concluded between the client and the bank or credit card issuer.

3.6. In case you purchase the goods, which are available for ordering on the Order - Delivery 7 to 14 days, we will deliver the goods within 14 days

4. ACCEPTANCE OF GOODS

4.1 The goods can be ordered at the Omniva or SmartPOST parcel terminal or at the address indicated by the customer using the SmartPOST courier service.

4.2. The Seller shall not be liable for any damage caused to the Customer if, for reasons beyond the control of the Seller, third parties have received a copy of the invoice or a unique order number and the Goods have been received on the basis thereof.

4.3. Delivery of goods from parcel machine

4.3.1. Buyer pays 3.20 € for delivery of goods to SmartPOST or Omniva parcel terminal. The cost of the goods transport is added to the invoice. The cost of returning the goods is borne by the customer.

4.3.2. Goods purchased from Monday to Thursday until 12:00 will arrive at the vending machine after the day of entry into force of the sales contract, except in the case of custom goods (see Section 4.4.4). Goods purchased from Friday to Sunday arrive at the parcel terminal on Tuesday at the latest after the sales contract enters into force. The parcel will be delivered to the parcel terminals of Saaremaa and Hiiumaa within 3 working days from the entry into force of the sales contract.

4.3.3. When the goods arrive at the parcel terminal, the customer is informed by an SMS message containing a unique door code to open the parcel terminal.

4.3.4. The Seller shall not be liable for any damage caused to the Customer if, for reasons beyond the control of the Seller, third parties have acquired the unique code of the parcel machine and the Goods have been received on the basis thereof.

4.3.5. If the customer has not accepted the parcel terminal after the expiry of the deposit term, the seller will read that the customer has given up the order and the seller will return the purchase amount together with the delivery fee immediately, but not later than within 14 calendar days to the same bank account from which the purchase was paid. The cost of returning the goods € 3.20 will be deducted from the refundable amount.

4.4. Delivery by courier

4.4.1. If you choose SmartKULLER for delivery of goods, you will receive a delivery fee of 6.80 €.

4.4.2. Goods delivered by a courier purchased from Monday to Thursday until 16:00 are delivered by courier to the address indicated by the customer for the purchase on the following day, except for order items from 10:00 to 21:00 (see Section 4.4.4). Goods purchased from Friday to Sunday will be delivered by courier to the address indicated by the customer no later than Tuesday 10.00 - 21.00. The exact time of delivery is agreed by the courier with the customer in advance by telephone.

4.4.3. The customer must ensure the receipt of the goods at the agreed time and address. If the customer is not available at the moment of arrival of the goods, the courier makes one additional attempt to deliver the goods. If both attempts to deliver the goods to the customer fail, the seller will read that the customer has given up the order and returns the purchase amount to the customer. In this case, the cost of delivery is borne by the customer. The purchase amount will be returned immediately, but not later than within 14 calendar days to the same bank account from which the purchase was made.

4.4.4 If you buy goods that are marked with Order on the Product - Delivery 7 to 14 days, we will deliver the goods within 21 days

4.5. Checking the goods

4.5.1. Upon receipt of the goods, the customer undertakes to open the product packaging carefully, without damaging the packaging and the products. If the customer has violated the packaging due to negligence, ie it was possible to open the product packaging without damaging it, the seller has the right to demand the destruction of the damage caused upon returning the goods. If the product packaging cannot be opened without breaking / breaking, the customer is not responsible for the damaged packaging.

4.5.2. In the event that the customer discovers that the goods have been sent incorrectly or defective or that the goods do not reach the customer in good condition and in sealed packaging, the customer's customer service must be informed immediately.

4.5.3. The seller is responsible for the goods purchased by the customer during its transportation. From the moment the goods are received, the risk of damage or loss of the goods is transferred to the customer.

5. PROCESSING CLIENT'S PERSONAL DATA

5.1. The Seller will use the personal data and data provided by the Customer regarding the purchases made in accordance with the Personal Data Protection Act to the extent necessary to fulfill the order submitted by the Customer in the e-store. The Seller shall not disclose the Customer's personal data to third parties, except to the postal or courier company, to the extent necessary to deliver the goods to the Customer.

5.2. The seller does not have access to the customer's bank data when paying for the goods via the Internet bank.

6. RECOVERY, WITHDRAWAL AND REPAYMENT OF GOODS

6.1. The Customer has the right to withdraw from the contract without giving any reason within 14 calendar days from the receipt of the goods (upon receipt of the notification of arrival of the goods in the SmartPOST parcel terminal, except in the case of defects in the product, see Section 7).

6.2. Since we are guided by paperless business, to return the goods, the customer can inform us via the contact module of blackpepper.ee http://blackpepper.ee/est/black-pepper/kontakt/ of his wish to withdraw from the contract. The seller will send you exact instructions for returning the goods. The cost of returning the goods is borne by the customer.

6.3. The Customer is obliged to return the goods to the Seller at the latest within 14 days after the withdrawal application is made.

6.4. The customer may exercise the right of withdrawal if the goods are unused (the suitability of the goods may be tried and used for inspection purposes) and undamaged. We recommend to the customer all the goods he recommends to return, return or deliver at one time. The direct costs of return are borne by the customer. We recommend returning the goods in the original shipping package.

6.5. According to the Law of Obligations Act, the right of withdrawal does not apply to goods which by their nature cannot be returned (eg, underwear from the packaging, swimwear, sunglasses, socks, cosmetics for open packaging, hygiene products for perfumes, foodstuffs and beverages).

6.6. If the customer has withdrawn from the transaction, the seller will return the purchase amount to the customer in accordance with clause 4.3.5 within 14 calendar days from the receipt of the withdrawal request to the seller. The refund will be made to the same bank account from which the purchase was made.

6.7. If the Customer has deliberately damaged or damaged the Goods to be returned or due to negligence, the Seller has the right to refuse to take back the Goods or to demand compensation for the damage caused.

7. SUBMISSION AND LIABILITY OF COMPLAINTS

7.1. The Seller is responsible for the non-conformity of the purchased goods within 2 years from the delivery of the goods to the customer. In the case of the sale of the goods to the consumer, it is assumed that the non-compliance with the terms of the contract, which appeared within 6 months from the date of delivery of the goods to the customer, was present at the time of transfer of the thing, if such presumption does not contradict the nature of the thing or defect. The Customer undertakes to notify the Seller of the non-conformity of the goods within 2 months of its discovery, ie to file a complaint.

7.2. It is advisable for the client to file a complaint by e-mail to info@blackpepper.ee or the Customer's name and contact details, the date of filing of the complaint, the lack of the goods and the content of the claim to be submitted, and to attach a document certifying the purchase.

7.3. The Seller shall not be liable for any damage or any other consequences arising from incorrect information provided by the Customer upon performance of the order, including delay in delivery, if this is due to circumstances beyond the Seller's control.

7.4. The Seller shall not be liable for any damage caused by the unintended use of the ordered goods.

7.5. Disputes between the seller and the customer will be resolved by the parties through negotiations. If the agreement is not reached, the client has the right to apply to the Consumer Protection Board (Rahohtu 2 Tallinn 10130, http://www.tarbijakaitseamet.ee) and the Consumer Disputes Committee (Rahohtu 2 Tallinn 10130, http://www.kission.ee) for the extra-judicial settlement of the dispute or to the Harju County Court. In addition, the European Union electronic platform (Online Dispute Resolution) at http://ec.europa.eu/odr is available to address complaints to all customers with open e-traders.
